Using the hyguku before he died he was reborn striped of his power and rank. But kept his battle exp and memories.

They're not confirmed to be dead (The three captains), Yoruichi, Urahara, or anyone like that. The only ones that are confirmed are the Arrancar, and there's one key difference.

Aizen is far too godlike, he is unmatchable with the Hogyoku. Giving him to anyone is basically giving them the ability to do as they please with no reprocussions. Issue? Not for you, but it would be to EVERYONE else when you come out with "lol that didn't hit me it was an illusion" bs.

Starrk and Harribel, I'll grant you, but their deaths were more ambiguous, and their survival can be explained. As for the others, the Wiki says "incapacitated"; it's not certain whether or not they're dead, and unless they're implicitly shown to be dead in the manga, one can't assume so. Urahara and Yoruichi certainly aren't finished, I can almost guarantee you that.

In any case, the issue appears to have been decided already.

One of my earlier posts will show that a lot of the Cannon characters are in the anime dead.
I can make up a reason the Tosen survives.
